"The Threat To 'Little Guy' Internet Earnings"

Probably you know that your BMI, ASCAP, or SESAC membership as a songwriter does not guarantee your song is paid royalties when it's recorded and released. Why is this?

BMI and ASCAP carved up the money pot a long time ago. These organizations collect airplay (radio) and performance (TV, clubs, arenas, festivals) royalty payments from radio stations and venues. The monies are paid out to songwriters and publishers of the songs.

The only problem is, only the top charting songs and writers are paid any royalties. Everyone who has a song recorded by a regional or local artist, or ones in "non-pop" genres such as folk, know they weren't paid one cent by BMI and ASCAP EVEN THOUGH THEIR SONG WAS GETTING AIRPLAY. Typically, even songs receiving wide airplay, but on AM and unpolled stations, are not paid one cent in airplay royalties.

And, your song may being performed widely at bluegrass festivals or in clubs across the U.S. and you're still not getting royalty checks. Why is this? Because all the payments are keyed to radio airplay, and BMI and ASCAP only poll SOME stations all the time, and a few stations, RANDOMLY. And all the rest, not at all. (Guess who supports the stations polled all the time? You got it, the major labels.)

WHAT'S ALL THIS GOT TO DO WITH INTERNET ROYALTIES? This: RIAA, AMPA, and NMPA/HFA are TRYING TO DO THE SAME THING WITH INTERNET ROYALTIES AS EXISTS WITH Airplay/Performance royalties, e.g. THEY ARE TRYING TO SEIZE CONTROL (a polite word for what it actually is, STEALING) OF INTERNET MUSIC EARNINGS.

NO ONE SAID THEY CAN HAVE IT. GOD DIDN'T SAY SO. THE U.S. CONSTITUTION DOESN'T SAY SO. AND NO LAW OR COURT IN THE WORLD SAYS THEY HAVE THE RIGHT TO DECIDE HOW THIS MONEY IS DIVIDED. In fact, playing or broadcasting music over the Internet is exactly the same as broadcasting music over radio airwaves - the Internet is just a communication medium (you know, plural is "media") - it's just a "channel" to use the techno-term. It carries information and music, and people play it on their mp3 players, just like a radio plays music coming over airwaves.

NO ONE OWNS IT. AND NO ONE AND NO CORPORATIONS HAVE DIVINE OR ANY OTHER AUTHORITY TO SEIZE CONTROL OF IT. You see, the RIAA, AMPA, and HFA want to take all the money for themselves, as in radio and performance royalties collections and payout. They DON'T WANT THE INDEPENDENTS TO HAVE THEIR FAIR SHARE BECAUSE IT'S REALLY SIGNIFICANT MONEY! THEY ARE CORPORATIONS, and corporations have ONE objective - to make a profit, to make money. Corporations do not have consciences!

WHY SHOULD YOU CARE? Because NOW you and I have the OPPORTUNITY TO EFFECT EQUITY in the distribution of Internet royalty monies. YOU OWN A PIECE OF IT IF YOU HAVE A SONG OR WORK ONLINE THAT'S DOWNLOADED OR STREAMED.

One is theft through breaking U.S.Copyright law, and the other is THEFT THROUGH SEIZURE OF MONIES NOT CONTROLLED BY ANY LAW.
